A $500 deposit is required in order to be placed on our waiting list for a puppy. The deposit is a commitment from the buyer to purchase a puppy from the us and therefore is non-refundable should the buyer choose not to complete the purchase. The entire deposit is refunded if a puppy is unavailable through no fault of the buyer within one year of the date of deposit.
The following guarantees and obligations are included in our purchase agreements:
The SELLER shall provide a current and accurate health record to the BUYER when the BUYER takes possession of the puppy.
The SELLER shall provide the American Kennel Club (AKC) registration* to the BUYER.
*Companion Puppy—Limited AKC Registration will be provided to the BUYER for a companion puppy and the BUYER may obtain Full AKC Registration after proof of sterilization by a licensed Veterinarian has been provided to the SELLER
*Working/Show Potential Puppy—Full AKC Registration will be provided to the BUYER for the purpose of entry into show events. The SELLER will use their best judgment to evaluate the show/working potential however there is no guarantee that a puppy evaluated as having “Show or Working Potential” will be successful in the show ring or in the work and no warranties or guarantees are made to that effect.
The SELLER represents that at the time BUYER assumes possession of the puppy, it will be positively identified with a microchip, examined by a licensed veterinarian and determined to be in sound health, free from symptoms of communicable disease and congenital defects and will be current on age appropriate vaccinations and dewormings.
If the dog develops a severe genetic health disorder prior to eighteen months of age that directly results in death or mandatory euthanasia of the dog as documented by veterinary records supplied by the BUYER to the SELLER, the SELLER shall replace the dog or refund the purchase price. Replacement or refund is the SELLER’s choice.
If the dog develops hip dysplasia prior to thirty months of age as evidenced by a Orthopedic Foundation for Animals report, supplied by the BUYER to the SELLER, based on x-rays submitted to OFA, the SELLER shall supply a replacement puppy at half the original purchase price or refund half the original purchase price. Replacement or refund is the SELLER’s choice.
If the dog develops SAS (cardiac sub aortic stenosis) prior to thirty months of age as evidenced by a written report of the results of an echocardiogram examination conducted by a board certified veterinary cardiologist, supplied by the BUYER to the SELLER, the SELLER shall supply a replacement puppy at half the original purchase price or refund half the original purchase price. Replacement or refund is the SELLER’s choice. Equivocal cardiac test results are not acceptable as confirmed proof of SAS.
If the BUYER desires a replacement or refund as described in this health guarantee, no replacement or refund shall be given if the BUYER does not adhere to ALL terms and conditions of this contract. A replacement puppy as described under the terms of this agreement shall be from a litter mutually agreed upon by both parties and any payment required for the replacement puppy shall be provided to SELLER prior to the picking up or the shipment of the puppy. All shipping and/or other transportation expenses, including any crate and health certificate necessary for shipping, shall be assumed by the BUYER and shall be paid in full to the SELLER prior to the shipment of the puppy.
The BUYER shall provide a name for the puppy to the SELLER no later than 7 weeks after birth corresponding with the assigned litter letter. If no name is provided by the BUYER a name will be chosen and assigned to the dog by the SELLER. This name and the SELLER’S kennel name shall be on the AKC registration (i.e. “A” litter would be Anna von den Dreibergen) and the AKC registered name shall not be altered without the SELLER’S consent.
Upon taking possession of the puppy, the BUYER shall personally inspect the puppy and if desired, have the puppy examined by a licensed Veterinarian within 48 hours of possession. Any claims of unsatisfactory health must be made in writing within this first 48 hours of possession. If the health of the puppy is found to be unsatisfactory by a licensed Veterinarian, documented in writing with a copy provided to the SELLER, the BUYER may return the puppy immediately to the SELLER for a full refund of the purchase price.
Upon taking possession of the puppy the BUYER shall assume all responsibility for the health, temperament, welfare and appearance. The BUYER shall properly train and socialize the dog and maintain the dog at all times in good health and humane condition.
The BUYER shall not spay or neuter the dog prior to two years of age unless it is deemed medically necessary for the health of the dog by a licensed veterinarian.
The BUYER shall not feed the dog a raw or home prepared diet prior to two years of age, the BUYER shall only feed a nutritionally appropriate commercially prepared diet prior to two years of age.
The BUYER shall not expose the dog to potential carcinogens or toxins including but not limited to lawn herbicides or pesticides and oral flea and tick control products (i.e. Comfortis, Trifexis, Bravecto etc.)
The BUYER shall not vaccinate the dog for Rabies or Leptospirosis prior to 6 months of age.
The BUYER shall maintain ownership of this dog and the BUYER may NOT transfer ownership of this dog without the SELLER’S knowledge and consent. If circumstances require that the BUYER must relinquish ownership of this dog, the dog and the signed AKC registration shall be immediately returned to the SELLER at the BUYER’S expense.
The BUYER shall not surgically alter the dog in any way or to correct, repair or otherwise modify any suspected or diagnosed health disorder potentially covered under the terms of this contract without the SELLER’S consent. The BUYER shall provide all veterinary documentation of suspected or diagnosed health disorder potentially covered under the terms of this contract to the SELLER within 14 days of diagnosis of such disorder. The SELLER has the right to require additional x-rays or testing at the SELLER’S Veterinarian of choice.
BREEDING IS PROHIBITED. The BUYER shall NOT breed this dog.
Violation of this agreement by the BUYER, whether accidental or intentional, shall result in Four Thousand Dollars ($4,000.00) as liquidated damages immediately due and payable to the SELLER.
The BUYER shall waive and release the SELLER, their employees, officers and agents from any and all liability of any nature, for any injury or damage or loss the dog may suffer or cause, directly or indirectly, to any property or person, including specifically, but without limitation, any injury or damage resulting from the action of this animal.
